Immediate 24 Hour Jail Release in Collin County, Texas and the Writ Bond

Most citizens being arrested are entitled to “bail”.  “Bail” is the security given by the accused to ensure that he/she will appear in court to answer the accusation brought against him/her. Bail is also commonly referred to as Bond.

When someone is arrested and taken to jail, they usually must wait to see a Magistrate Judge to be “Arraigned” (brought before the Court, read the charges, and a bond amount is set) before they can post bail and be released from jail. This means that an arrested person may have to sit in jail overnight, or longer, before they can be released. This can be a big issue for many people with jobs, health concerns, families, and household duties that cannot be put on hold.

For some misdemeanor cases, the Collin County Court at Law Judges have set up a way for people being accused of a crime to have a bail amount set prior to arraignment by a magistrate judge. When a person has been arrested for certain alleged misdemeanors committed in Collin County, an attorney can file a Writ of Habeas Corpus, “Writ”, at the jail and the bond will be automatically set at a previously determined amount. With an Attorney Writ Bond, the arrested person will not have to wait around in jail for a Magistrate Court to hold his or her arraignment hearing before they can post bail, be released, and return to their family and duties.
